Official Rules and Regulations

By participating, you agree that:

The Stewarts Creek High School Music Boosters 2019 Raffle, hereafter “Raffle” is a fundraising activity conducted by Stewarts Creek High School Music Boosters, Inc. hereafter “SCHS Music Boosters” in support of the Stewarts Creek High School Band Program.

These Official Rules and Regulations govern the conduct of the Raffle and together with the decisions of SCHS Music Boosters are binding on everyone who purchases a Raffle ticket and/or who is named on a Raffle ticket. It is the responsibility of the ticket purchaser or person named on a Raffle ticket to review the Official Rules and Regulations for modifications or supplements. These official rules and regulations may not be waived, modified or supplemented, except by SCHS Music Boosters, in writing. No modification of these official rules and regulations shall be enforceable unless made by the SCHS Music Boosters in writing and approved by its board of directors.

TICKET COST AND ODDS OF WINNING: The price per one (1) ticket is $20; for three (3) tickets sold to the same person is $50; and for seven (7) tickets sold to the same person is $100. For sale of multiple tickets (3 for $50 and 7 for $100) to individuals, the individual’s name as entrant and all contact information must appear the same on all tickets. A maximum of 5,500 tickets will be sold. Ticket sales will cease when the maximum number of qualified entries is reached. Any requests and payments received following the cutoff time for the drawing, or after the sale of 5,500 tickets will be returned to the sender. The odds of winning a prize depends on the number of eligible entries received and accepted by the stated cutoff for the drawing. However the odds of winning will never be greater than 5,500 to 1.

ELIGIBILITY: Raffle ticket purchasers and the person named on a Raffle ticket must be at least 18 years of age at the time of purchase. Raffle tickets may not be purchased in the name of a business, trust, corporation or other entity or wherever prohibited by applicable law. SCHS Music Boosters officers and persons related by blood or marriage, living in the same household as an SCHS Music Boosters officer, are not eligible to win the Raffle. Prize winners may be required to sign an affidavit of eligibility. Offer void where prohibited by law.

DRAWING: The drawing for all prizes in the Raffle will be held on Friday October 25, 2019 on the campus of Stewarts Creek at 301 Red Hawk Boulevard, Smyrna, Tennessee, except this date and all other dates stated in these rules may be extended at the absolute discretion of SCHS Music Boosters after notification and approval by the Tennessee Secretary of State. The winning ticket for each prize will be drawn at random from a drum containing all eligible Raffle tickets. The grand prize ticket will be drawn first, after the first tumble of tickets. The grand prize ticket will be removed from the drum and is not eligible for drawings for subsequent prizes. The second prize ticket will be drawn second after the second tumble of tickets. The second prize ticket will be removed from the drum and is not eligible for drawings for subsequent prizes. This pattern continues until tickets have been drawn for all prizes advertised. The drawing is open to the public; however the winner does not need to be present to win.

​Cutoff for Ticket Purchases: Ticket requests by mail must be received before 5:00 PM CDT Wednesday October 16, 2019 to be included in the drawing. Online ticket purchases may be made until 12:00 PM on Friday October 25, 2019. As noted above, a limited number of tickets will be sold for the Raffle. Therefore all tickets may sell out before the day of the drawing.

Substitute Prizes in The Event of Non-sellout of Tickets: If fewer than 2,200 Raffle tickets are sold, SCHS Music Boosters reserves the right in its absolute discretion to substitute 28%, 13%, 6%, 2% and 1% for each prize level, respectively, of the gross sales revenue from the tickets sold before 12:00 PM CDT Friday October 25, 2019. SCHS Music Boosters reserves the right to cancel this Raffle contest at any time in which event liability is limited to the refund of the ticket price to all participants.

TAXES AND OTHER COST OF OWNERSHIP: SCHS Music Boosters does not undertake to give advice on the legal or tax consequences of the Raffle or its winner. However it understands that the IRS position is that amounts paid for chances in Raffles, lotteries or similar drawings for valuable prizes are not gifts and consequently do not qualify as deductible charitable contributions.

Each Raffle winner assumes and must pay all fees and charges (including but not limited to tags and license), income taxes (local, state and federal taxes) when the prize is  transferred to the winner. In addition all costs of prize ownership, including but not limited to insurance, if applicable, are the winner's sole responsibility. SCHS Music Boosters assumes no responsibility for a prize winner's tax obligations and suggests you consult your tax advisor. Applicable forms will be filed with the Internal Revenue Service to report the value of each prize won. The winners will also receive a copy of these forms. All required forms will also be filed with the Tennessee Department of State, Division of Charitable Solicitations, Fantasy Sports and Gaming. This offer is void where prohibited by law and all federal, state and local laws and regulations apply.

PRIZE WINNERS ARE STRONGLY ADVISED TO SEEK PROFESSIONAL LEGAL TAX ADVICE. AWARD OF PRIZES COULD HAVE MATERIAL ADVERSE CONSEQUENCES ON THE PRIZE WINNER INCLUDING WITHOUT LIMITATION, WITH RESPECT TO TAXES, INCOME, GOVERNMENT ENTITLEMENTS OR OTHER BENEFITS, OR OTHER LEGAL, FINANCIAL OR OTHER MATTERS.

By participating in this Raffle, all ticket purchasers and the person named on each Raffle ticket accept and agree (1) to be bound by all the rules, limitations and restrictions set forth here, and (2) that their names and/or photograph and/or video likenesses and any statements may be disclosed to and used by the news media and may otherwise be used by SCHS Music Boosters for publicity purposes and naming of the prize winners to be published in area newspapers or other media including television, radio, Internet and print. The prize winners will be published on the SCHS Music Boosters website (www.schs.band). Names of the winners may be obtained by sending a written request plus a self-addressed, stamped envelope to SCHS Music Boosters, P.O. Box 1587, Smyrna, TN 37167. SCHS Music Boosters’ interpretation and application of the rules and regulations shall be final.

All participants release SCHS Music Boosters and Rutherford County Schools, and each of their respective directors, officers, contractors and agents from any and all liability for injuries, losses or damages of any kind caused by any prize or resulting from acceptance, possession, use or misuse of any prize and each winner agrees to indemnify and hold SCHS Music Boosters and Rutherford County Schools and each of their respective directors, officers, contractors and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of the winner's acceptance or use of any prize.

TICKETS: Tickets may be purchased in person by a) cash, check or at some venues by credit or debit card, b) by mail with a check or c) online by credit or debit card.

You have not entered the Raffle until your entry submission with full payment has been accepted by SCHS Music Boosters. If a submission is accepted it will be deemed to have been accepted on the date and time at which the submission was received by SCHS Music Boosters regardless of the date that SCHS Music Boosters notifies you of the acceptance of your submission. Tickets may be purchased solely from SCHS Music Boosters. You may buy as many tickets as you wish subject to availability until all 5,500 tickets are sold. Each Raffle ticket will be entered separately in the drawing. Each Raffle ticket is a separate and equal chance to win a prize.

To order tickets by mail use the ticket request form which can be downloaded from www.schs.band/raffleticketbymail .Mail order ticket requests must include payment by check or money order (no cash) made payable to “SCHS Music Boosters”, along with all information required on the ticket including printed name, address, phone number, email address and an indication acquiescing to all rules of the Raffle. Send completed mail order forms with payment to Stewarts Creek High School Music Boosters c/o Car Raffle, P.O. Box 1587, Smyrna, TN 37167.

To order tickets online access the online Raffle ticket application at www.schs.band/2019raffletickets. Online Raffle ticket purchases must be completed by making payment using a debit or credit card only. The online Raffle ticket order form must be completed in its entirety including name, address, phone number and email address. Individuals ordering Raffle tickets online must indicate their agreement to acquiesce to all rules of the Raffle.

When a Raffle ticket order is placed by mail or online and funds have cleared, SCHS Music Boosters will complete the entry information slip for the entrant by filling in the name, address, email address and phone number. SCHS Music Boosters will place each completed raffle entry slip into the secured raffle drum. The purchaser will receive notification containing ticket numbers upon online ticket purchase.

If for any reason a check or credit card or debit card payment does not clear the purchaser’s bank the ticket purchase is null and void. Additionally all defective or physically altered request forms are subject to disqualification at the discretion of SCHS Music Boosters. Prior to the prize drawing SCHS Music Boosters will make a reasonable effort to notify any individual who submits such an entry form or one which has been rejected because the funds did not clear that the entry has been rejected. Any cure to the problem shall be considered a new order and processed in the order received. All requests for tickets for the drawing must be received and/or purchased by the indicated deadline(s).

All entries must be fully completed in order to be eligible, including the printed name, address, phone number and email of the entrant as well as an indication of the entrant’s agreement to abide by the rules of the Raffle as prescribed herein.

REFUNDS: All Raffle ticket sales are final. Any ticket request received after 5,500 tickets are sold or after the entry deadline will be destroyed; and any verified payment associated with a ticket request received after 5,500 tickets have been sold or after the entry deadline will be returned. No other refunds are available. SCHS Music Boosters assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages or any other failure to receive orders or deliver receipts prior to the drawing deadlines. A Raffle participant's sole and exclusive remedy for SCHS Music Boosters breach shall be limited to the return of the purchase price paid for his or her Raffle ticket(s). In no event shall SCHS Music Boosters nor its respective directors, officers, contractors, members, committee members, agents, advisors or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill or for any incidental, special, punitive or consequential damages of any person or entity.

TICKET AND PAYMENT VERIFICATION: SCHS Music Boosters reserves the right to reject any ticket request form that is submitted with payment that does not constitute "good funds". All defective or physically altered request forms are subject to disqualification at the discretion of SCHS Music Boosters. Prior to each drawing described herein SCHS Music Boosters will make a reasonable effort to notify any individual who submits such an entry form, or one which has been rejected because the check did not clear that the entry has been rejected. All requests for tickets for the drawing must be received and/or purchased by the indicated deadline(s).

NOTIFICATION AND CLAIMING OF PRIZES: In order to claim any prize the winner must provide proper identification to the satisfaction of SCHS Music Boosters. Each winner must elect to receive the prize awarded by notifying SCHS Music Boosters of his/her election in writing by 5:00 PM on Monday November 25, 2019 (30 days from date of original drawing). If the winner is not present at the drawing, SCHS Music Boosters will contact the winner by phone, email and certified mail within seven (7) days of the drawing. In all cases the winner will be notified that they shall claim the prize within thirty (30) days of the original drawing event or each time a winner is drawn in a subsequent drawing should the winner decline for any reason.

If a winner does not wish to claim a prize but wishes to donate it to the SCHS Music Boosters the winner shall provide SCHS Music Boosters a written and notarized statement within the thirty (30) day period following the drawing, stating that the winner wishes to donate the prize to the SCHS Music Boosters. The donor will then be required to sign a Donation Document created by SCHS Music Boosters. A prize winner shall not donate the prize back to the SCHS Music Boosters if to do so would violate Tennessee state law.

If a Raffle winner does not claim the prize or donate it to SCHS Music Boosters within thirty (30) days after the drawing, SCHS Music Boosters shall notify the Tennessee Department of State, Division of Charitable Solicitations, Fantasy Sports and Gaming and draw another ticket in the presence of ”Office” personnel. The tickets shall remain under the control of SCHS Music Boosters until a winner is identified and accepts the prize.

REGISTRATION WITH THE STATE OF TENNESSEE: This Raffle is conducted for the benefit of the Stewarts Creek High School Band Program by Stewarts Creek High School Music Boosters, Inc. and authorized by the Tennessee Department of State, Division of Charitable Solicitations, Fantasy Sports and Gaming and the Tennessee General Assembly; license number CO30368.
